Terms of Service

These Terms govern your use of Deflation (the “Service”), a prepaid API platform that powers OpenClaw bot instances. By creating an account or topping up credits, you agree to these Terms.
1. The Service
Deflation provides metered API access to language-model, SMS, voice, email, and Telegram infrastructure on behalf of customer bots running on dedicated server instances. Each request is debited from a prepaid wallet at the rates published on the Pricing page.
2. Eligibility and account
You must be at least 18 years old and able to enter binding contracts in your jurisdiction. You are responsible for keeping your sign-in credentials secure and for all activity carried out under your account.
3. Acceptable use
You may not use the Service to:
- send unsolicited bulk messages, deceptive content, or phishing;
- distribute, generate, or process content that is illegal in Switzerland or the recipient’s jurisdiction (including CSAM, threats, harassment, malware, or sanctioned-party communications);
- circumvent or attempt to compromise the platform’s security or rate limits;
- resell raw API access to third parties without prior written consent.
We may suspend or terminate accounts that violate these rules. For suspected criminal activity we cooperate with the relevant authorities.
4. Pricing and billing
Credits are prepaid in CHF via Paddle, our merchant of record. Each request is debited at the rates in effect at the time it is processed. We may change the published rates with at least 30 days’ prior notice by email; existing prepaid balances are unaffected.
Paddle handles payment processing, applicable VAT/GST collection, and invoicing. Receipts are sent to the email address on your account.
Consumed credits are non-refundable. Once a credit is debited from your wallet for an actual API request — for example a language-model call, an SMS, a voice minute, or an outbound email — the underlying compute and third-party costs have already been incurred on your behalf and cannot be reversed.
5. Refunds
Topping up is a commitment to spend on the platform, not a deposit. Consumed credits are non-refundable. Unused balance does not expire and remains usable as long as your account is active. Refunds of unused balance are available only at our discretion in limited cases described in the Refund Policy.
6. Service availability
We target 99% monthly uptime measured at the API edge. Planned maintenance is announced at least 48 hours in advance. We do not publish formal SLA credits; documented service incidents that materially affect your usage will be compensated in service credit at our discretion.
7. Your data
The Service necessarily processes the content of messages your bot sends and receives (email bodies, SMS, transcripts of voice calls, Telegram messages) so that the bot can function and so that you can review past activity in the dashboard. Our handling of that data is described in the Privacy Policy.
8. Intellectual property
Deflation retains all rights in the platform software, documentation, and brand. You retain all rights in the content you submit through the Service. You grant us a limited licence to process that content solely to operate the Service for you.
9. Termination
You may close your account at any time from your dashboard settings or by emailing us. Unused balance on closure is handled per the Refund Policy. We may suspend or terminate accounts for material breach with reasonable notice; egregious abuse may result in immediate termination.
10. Limitation of liability
To the fullest extent permitted by Swiss law, our aggregate liability for any claim arising out of the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including loss of profits or data.
11. Governing law and disputes
These Terms are governed by the laws of Switzerland, excluding its conflict-of-laws rules. The exclusive place of jurisdiction for any dispute is the courts of Zurich, subject to any mandatory consumer protections that apply where you reside.
12. Changes
We may amend these Terms; material changes will be communicated by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
